Purpose of this page

This page explains how Blogging by the Minute handles copyright concerns, including takedown requests and counter notices. It is an overview of our process and does not constitute legal advice.

Our policy in brief

We respect creators’ rights. If you believe that material on this site infringes your copyright, you can send us a notice. When we receive a valid notice, we remove or disable access to the material and notify the contributor if applicable. We also accept counter notices when someone believes their content was removed by mistake.

What qualifies as a proper notice

For us to act quickly, your notice should include all items below. Please write in clear language so we can verify the claim.

  1. Your full name and role, and if you act for someone else, the name of the rights holder.
  2. Contact information: email address, postal address, and phone number.
  3. A description of the copyrighted work you claim is infringed. If multiple works are involved, list a representative set.
  4. The exact location on our site where the material appears. Include the full page title and the specific section or paragraph.
  5. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.
  7. Your physical or electronic signature. Typing your full name at the end of the email counts as an electronic signature.

How to send a takedown notice

If you mail a letter, please also send a copy by email so we can begin review without delay.

What happens after you send a notice

  1. We confirm receipt and assign a case reference.
  2. We review the notice for completeness and authenticity.
  3. If valid, we remove or disable access to the material.
  4. We notify the contributor or author and share the substance of the claim.
  5. We keep a record of the request and our action.

Counter notice process

If your content was removed and you believe this was a mistake or a misidentification, you may send a counter notice. Include the items below.

  1. Your full name, email address, and postal address.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. A statement that you consent to the laws and courts that apply in your place of residence for resolving the matter and that you will accept service of process from the person who sent the original notice or their agent.
  5. Your physical or electronic signature.

Repeat infringer policy

Where we host user contributions, we may suspend or terminate access for users who repeatedly infringe copyrights. We keep internal records to identify repeat issues and apply this policy in a fair and consistent manner.

Misrepresentation

Knowingly submitting false claims or counter claims can carry legal consequences. Please make sure you have the right to act and that your statements are accurate.

Third party content and fair use

Some material on this site may be used for commentary, criticism, reporting, teaching, or research. Such uses can be lawful under applicable doctrines like fair use or fair dealing. Each case depends on specific facts. We review complaints with this in mind.

Non hosted material

If allegedly infringing content is hosted by a third party and only embedded or linked here, we may direct you to that host as well, since they control the actual file. We will still review the reference on our pages.
